This policy outlines the procedures for submitting notifications of claimed copyright infringement under the Digital Millennium Copyright Act (“DMCA“). It also explains how you may file a counter-notification if you believe material was removed in error.
1. Reporting Copyright Infringement
If you are a copyright owner or an agent thereof and believe that any content, material, or user submission hosted on or processed through EssentialTools.online infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address.
A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Counter-Notification Procedures
If you believe that your content was removed (or access to it was disabled) as a result of a mistake or misidentification of the material, you may send us a counter-notification pursuant to 17 U.S.C. §512(g)(2) and (3).
To be effective, your counter-notification must be in writing and include substantially the following:
Your physical or electronic signature.
Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, for any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
Upon receipt of a valid counter-notification, we will promptly forward it to the party who submitted the original claim. If they do not notify us within 10 business days that they are seeking a court order to prevent further infringement, we may replace or restore the removed material in our sole discretion.
3. Repeat Infringers
It is our policy, in appropriate circumstances and at our discretion, to disable or terminate the accounts of users who are repeat infringers of intellectual property rights.
